SMS Messaging Policy

This SMS Messaging Policy ("Policy") governs the Short Message Service ("SMS") and Multimedia Messaging Service ("MMS") communications provided by Esaias and Company dba Detailers ("Company", "we", "us", or "our") to users of our mobile detailing business management platform ("Service"). By providing your mobile telephone number and opting into our SMS communications, you acknowledge that you have read, understood, and agree to be bound by the terms of this Policy.

Section 1 – Consent and Authorization

By providing your mobile telephone number to us and expressly opting into our SMS messaging service, you hereby consent and agree to receive text messages from Esaias and Company at the mobile number provided. This consent constitutes a written agreement under applicable federal and state laws, including but not limited to the Telephone Consumer Protection Act ("TCPA").

You acknowledge and agree that your consent to receive SMS communications is not required as a condition of purchase or use of any goods or services offered by the Company, except where such communications are essential for the provision of the Service.

You represent and warrant that you are the authorized user of the mobile telephone number provided and that you have the authority to provide this consent.

Section 2 – Message Content, Purpose, and Frequency

The Company will send SMS communications solely for legitimate business purposes, including but not limited to:

  • Two-factor authentication and account verification codes
  • Account security notifications and authorization requests
  • Service-related notifications and updates following subscription to our Service
  • Transactional communications related to your account and subscriptions
  • Important announcements regarding changes to our Service or policies

Message frequency will vary based on your account activity, subscription level, and security requirements. You may receive multiple messages per month depending on your use of the Service. Standard message and data rates imposed by your wireless carrier may apply to all SMS communications.

Section 3 – Opt-Out and Unsubscribe Procedures

You may revoke your consent to receive SMS communications at any time by replying "STOP" to any text message received from us. Upon receipt of your opt-out request, we will:

  • Immediately cease sending promotional and non-essential SMS communications
  • Send you a final confirmation message acknowledging your opt-out request
  • Remove your mobile number from our SMS marketing lists

Please note that opting out of SMS communications may not prevent you from receiving essential account-related messages necessary for the provision of the Service, including security alerts and critical account notifications.

To reactivate SMS communications after opting out, you must expressly re-consent through our Service interface or by following the re-subscription procedures we may provide.

Section 4 – Customer Support and Help Instructions

For assistance with our SMS messaging service, reply "HELP" to any text message from us. This will provide you with information about our messaging service, including instructions on how to unsubscribe and contact information for customer support.

Additional support may be obtained by contacting us through the methods specified in Section 8 of this Policy.

Section 5 – Data Collection, Use, and Privacy

In connection with our SMS service, we collect and process your mobile telephone number and related messaging data for the sole purpose of delivering requested communications and maintaining our Service.

We do not sell, rent, lease, or otherwise monetize your mobile telephone number or SMS communication data to third parties for their marketing purposes.

Your mobile number and associated data may be shared with trusted third-party service providers, including SMS platform providers and telecommunications carriers, who are contractually obligated to maintain the confidentiality and security of such information and use it solely for the purpose of delivering our SMS communications.

Our collection, use, and disclosure of your personal information in connection with SMS communications is governed by our Privacy Policy, which is incorporated herein by reference.

Section 6 – Disclaimer of Warranties and Limitation of Liability

SMS communications are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the reliability, availability, timeliness, or accuracy of SMS delivery.

Neither the Company nor its affiliates, service providers, or wireless carriers shall be liable for delayed, undelivered, misdirected, or otherwise failed SMS communications. You acknowledge that SMS delivery is subject to network availability, carrier policies, device compatibility, and other factors beyond our control.

In no event shall the Company be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to SMS communications, including but not limited to damages for lost profits, business interruption, or loss of data.

Section 7 – Compliance and Legal Requirements

Our SMS communications comply with applicable federal and state laws and regulations, including the TCPA, CAN-SPAM Act, and other relevant telecommunications and privacy laws.

By consenting to receive SMS communications, you agree to comply with all applicable laws and regulations in your jurisdiction regarding the receipt and use of such communications.

Section 8 – Integration with Terms of Service and Privacy Policy

This SMS Policy supplements and is incorporated into our Terms of Service and Privacy Policy. By agreeing to receive SMS communications, you also acknowledge and agree to be bound by our:

In the event of any conflict between this SMS Policy and our Terms of Service or Privacy Policy, the terms of this SMS Policy shall govern with respect to SMS communications.

Section 9 – Policy Updates and Modifications

We reserve the right to modify this SMS Policy at any time by posting the updated policy on our website. Material changes will be communicated to you via SMS or through other appropriate means. Your continued participation in our SMS service following notice of changes constitutes acceptance of the modified policy.
